A Niagara Falls man was charged with DWI about 12:40 a.m. Monday after an officer on patrol found him sleeping in his running vehicle on 19th Street.
The officer said he was heading north on 19th Street toward Ferry Avenue when he pulled up behind a stopped Ram truck at the intersection of 19th and Ferry. After waiting several moments for the vehicle to begin moving, the officers initiated a traffic stop.
When the officer approached the truck, Nick J. Marino, 32, 1323 Whitney Ave., was sleeping at the wheel. After several attempts, the officer said they awoke Marino who started to laugh and began to pull away. The officer ordered Marino to stop and turn the car off, which he did.
The officer said Marino was slurring his words and said he had drank about six beers during the night. He refused to take field sobriety tests and was arrested at the scene. His vehicle was towed.
In addition to DWI, Marino was charged with illegal stop and refusal to take a breath test.
