LOCKPORT

Traffic stop leads to felony DWI arrest

A woman stopped for not wearing a seat belt was eventually charged with felony DWI about 6:30 p.m. Friday by Niagara County Sheriff's deputies.

Mary R. Ball, 39, 3902 Lockport-Olcott Road, Lockport, was stopped in a parking lot on Lockport-Olcott Road for the seat belt violation. Deputies said she appeared intoxicated and failed four of five field sobriety tests.

Ball told the deputy she was driving with a hardship driver's license due to a previous DWI arrest. When the deputy asked why she was driving to the store, she replied she had to return a movie. The deputy noted that Ball acknowledged that driving to return a movie is not a stipulation of her hardship driving privilege.

A chemical test determined her blood alcohol content to be 0.13 percent.

Due to the previous DWI, on Sept. 4, 2008, and a suspension on her license for a pending prosecution in court, she was charged with felony DWI, first-degree aggravated unlicensed operation, DWI, unlicensed operation and no seat belt.
