Niagara County Sheriff's deputies called out regarding an ATV accident about 9 p.m. Sunday charged one of the drivers with DWI.
Deputies met up with Nicholas L. Criswell, 27, 8519 Ertman Road, Lockport, at his home. He said he had about seven beers with some pizza and went out riding ATVs with some friends on Block Church Road in Royalton.
Criswell said he was operating his Polaris Ranger with four other people riding on the ATV with him. The Polaris Ranger is a larger ATV with a cab and room for multiple passengers and is also referred to as a UTV. At one point, another ATV riding alongside him rubbed tires with his vehicle causing both drivers to lose control. All five people on Criswell's ATV were ejected.
Criswell — who was not wearing a helmet at the time — was knocked unconscious. When he awoke, he went home. He was evaluated by a Rural Metro Ambulance crew and it was determined that he needed to be evaluated at Erie County Medical Center.
At ECMC, Criswell was failed field sobriety tests and agreed to have blood drawn for a blood test.
Criswell was charged with DWI, leaving the scene of an injury accident and operating an unregistered ATV.
There was no mention of serious injuries suffered by any of his passengers.
