TOWN OF NIAGARA: Construction worker struck by car

Driver charged in crash that leaves man in critical condition

A Wilson man is in critical condition at Erie County Medical Center after he was struck by a car while working construction Wednesday morning in the Town of Niagara.

Niagara County Sheriff’s deputies said 46-year-old Kevin Forsyth was struck while he was placing cones on the side of Porter Road.

Deputies said 47-year-old Frank Serba of Wheatfield was driving east on Porter Road when he dropped a cigarette, causing him to veer left across the center lane.

Serba’s car crossed through the westbound lane and onto the shoulder of the road, striking Forsyth.

Forsyth was transported to ECMC by Rural Metro Ambulance. He was listed in critical condition Wednesday evening.

Serba was charged with failure to keep right.

The accident is under investigation, and further charges may be pending.
