• DWI: James Aviles III, 20, 16 Sidway St., Buffalo, was charged Sunday with driving while intoxicated, drinking alcohol in a motor vehicle on the highway, moving from a lane unsafely and driving with unsafe tires after a traffic stop on Niagara Falls Boulevard. Niagara County Sheriff’s deputies spotted Aviles cross the lane lines near Military Road, the report said. The car was making an unusual noise and deputies soon realized it was caused by a flat tire, which was smoking and shredding as Aviles drove. Aviles was pulled over near 76th Street and said he was unaware of the tire damage. Aviles had a partially consumed bottle of Bud Ice in the cup holder of the car and appeared intoxicated. He said he’d had two beers at the casino and was driving to drop someone off in Kenmore. Aviles failed several field sobriety tests and registered a 0.21 percent blood alcohol content on a breath test.

One dog was bleeding and being held down on the ground by the neck by the other dog. Deputies tried to separate the dogs using water and voice commands, but were unsuccessful, the report said. The dogs were sprayed with Mace, which caused them to separate. The report said none of the injuries appeared serious.

Inside the bag, the man found a box, inside which was another bag containing a dead Jack Russell terrier. The dog was wearing a pink collar with a red leash, the report said. There were no injuries on the dog, but it did not appear the dog died of natural causes. The SPCA was notified and took possession of the dog, the report said.

• HARASSMENT: Mark J. Brinson, 33, 8025 Ridge Road, Gasport, was charged Sunday afternoon with second-degree harassment, second-degree menacing and fourth-degree criminal mischief. Officers responded to a Pine Street home in response to an unwanted person report and found Brinson getting into a car. Brinson reportedly had cuts on his hands and said the woman in the home owed him $250. When officers asked where he got the cuts, he allegedly said, “She owes me money, man!” The woman told police Brinson came to the door and they argued. He allegedly told her, “I’m going to kill you,” and swung a frying pan at her. Brinson allegedly grabbed a butcher’s knife and swung it at her. The woman said she ran to the bedroom, and Brinson began throwing items around the room, breaking her DVD/VCR player in the process. He allegedly struck the woman in the chest with his fist. He was arrested and held in lieu of $500 bail.
