BLOTTER: Police reports published July 8

Staff Reports
Niagara Gazette

Niagara Falls

• DWI: James Aviles III, 20, 16 Sidway St., Buffalo, was charged Sunday with driving while intoxicated, drinking alcohol in a motor vehicle on the highway, moving from a lane unsafely and driving with unsafe tires after a traffic stop on Niagara Falls Boulevard. Niagara County Sheriff’s deputies spotted Aviles cross the lane lines near Military Road, the report said. The car was making an unusual noise and deputies soon realized it was caused by a flat tire, which was smoking and shredding as Aviles drove. Aviles was pulled over near 76th Street and said he was unaware of the tire damage. Aviles had a partially consumed bottle of Bud Ice in the cup holder of the car and appeared intoxicated. He said he’d had two beers at the casino and was driving to drop someone off in Kenmore. Aviles failed several field sobriety tests and registered a 0.21 percent blood alcohol content on a breath test.

• BURGLARY: Police are investigating a burglary in the 5600 block of Charles Avenue. A 49-year-old man told officers that sometime between 2 and 10:30 p.m. Sunday, someone entered a home he was remodeling and took an assortment of hand and power tools and a 30-inch TV.

• LARCENY: A Pennsylvania man reported Saturday that while his car was parked on Feigle Road someone entered it and stole two knives valued at $30 and damaged his $50 plastic gun case.

• LARCENY: A Campbell Boulevard man reported Saturday that someone entered his car and stole his portable GPS, $10 in rolled coins and assorted bird books, together worth about $620. About the same time, another Campbell Boulevard man reported his car was broken into and his $400 GPS unit was also stolen.

Wheatfield

• CAR FIRE: A Graydon Drive man reported Sunday afternoon that his daughter noticed his 2000 Ford Expedition was on fire in their driveway. The man said he put the fire out with a fire extinguisher. The origin of fire appeared to be electrical, and there was extensive damage to the engine compartment, the report said. Damage was estimated at $5,000.

Town of Lockport

• DOG FIGHT: Deputies responded to Niagara Street Extension on Friday evening for a report of two dogs involved in a vicious fight. One dog was bleeding and being held down on the ground by the neck by the other dog. Deputies tried to separate the dogs using water and voice commands, but were unsuccessful, the report said. The dogs were sprayed with Mace, which caused them to separate. The report said none of the injuries appeared serious.

• ANIMAL: A Tonawanda Creek Road man reported Sunday that he found a bag lodged up against a concrete barrier in the creek behind his home. Inside the bag, the man found a box, inside which was another bag containing a dead Jack Russell terrier. The dog was wearing a pink collar with a red leash, the report said. There were no injuries on the dog, but it did not appear the dog died of natural causes. The SPCA was notified and took possession of the dog, the report said.

City of Lockport

• DISORDERLY: Paul F. Owens, 49, 198 Pine St., Apt. 3C, and George L. Dash, 42, 198 Pine St., upper, were each charged Sunday afternoon with disorderly conduct. Owens and Dash allegedly had an argument at their apartment building and were loudly swearing. Several people reported hearing the men.

• HARASSMENT: Mark J. Brinson, 33, 8025 Ridge Road, Gasport, was charged Sunday afternoon with second-degree harassment, second-degree menacing and fourth-degree criminal mischief. Officers responded to a Pine Street home in response to an unwanted person report and found Brinson getting into a car. Brinson reportedly had cuts on his hands and said the woman in the home owed him $250. When officers asked where he got the cuts, he allegedly said, “She owes me money, man!” The woman told police Brinson came to the door and they argued. He allegedly told her, “I’m going to kill you,” and swung a frying pan at her. Brinson allegedly grabbed a butcher’s knife and swung it at her. The woman said she ran to the bedroom, and Brinson began throwing items around the room, breaking her DVD/VCR player in the process. He allegedly struck the woman in the chest with his fist. He was arrested and held in lieu of $500 bail.

• LARCENY: A Lincoln Avenue man reported Monday that someone stole some of his construction equipment from Bristol Avenue. The man said three fiberglass ladders, together worth $600, had been stolen, along with three pieces of aluminum scaffolding, together worth $1,200.

• IMPERSONATION: David M. Klozbach, 28, 6067 Fisher Road, Oakfield, was charged Monday with second-degree criminal impersonation and third-degree aggravated unlicensed operation of a motor vehicle. Klotzbach allegedly gave officers his brother’s name during a traffic stop Jan. 18 on Roosevelt Drive. His brother later contested tickets and told police his brother may have been impersonating him. Klotzbach was released on his own recognizance.
