Rowdy hotel patron charged
An off-duty Falls police officer working security at the Crowne Plaza Hotel, 300 Third St., reported early Saturday morning that he heard loud noises and glass breaking and found a light valance broken in a hallway and two men loudly arguing in a room nearby.
Eventually, the officer got into the room and confronted James M. Murphy, 47, of Elmhurst, Ill., who was intoxicated, argumentative and uncooperative, the report said.
With the help of two on-duty police officers, Murphy was taken into custody and charged with disorderly conduct, resisting arrest and obstruction of governmental administration.
Abuse of child probed
Falls police were called to Sam’s Club on Porter Road Friday afternoon after a customer and worker there saw a woman beating a child in her car in the parking lot.
The two witnesses said the woman was using both hands to hit the child. She had left the scene before police arrived.
Officers did see the incident on a store security camera. The incident is being investigated.
Three arrested at Hard Rock
Three people were arrested at the Hard Rock Cafe, 333 Prospect St., Friday night basically because they refused to listen to police officers.
At 11 p.m., officers broke up a fight between two women at the front of a stage. One of the women, Angelina M. Stewart, 29, Ellington, N.Y., was charged with disorderly conduct for refusing to give up the fight with the other woman after police had intervened.
About 11:30 p.m., Dominick M. Justiana, 21, 5935 Kline Road, Lewiston, was escorted out of the bar by police. Ordered to leave the area, Justiana refused and became abusive towards police, the report said.
While struggling with Justiana, police said David D. Spacone Jr., 21, 979 Rankine Road, tried to intervene. After a brief struggle, both men were eventually arrested by police.
Both men were charged resisting arrest, obstruction of governmental administration and disorderly conduct.
Hit-and-run report leads to two arrests
Falls police were called to a Ninth Street residence about 5 a.m. Saturday where a woman told them someone had run over her grandson with their car. The grandson, Raemon M. Smith, was at the residence and when he spotted police, said, “Man, I can’t believe she hit me with her car. ... She broke my $700 phone.” Officers noted Smith had a laceration on his chin.
The woman, Tia Cook, 2411 North Ave., Apt. 1, was quickly located in her car on North Avenue, where officers determined she was intoxicated.
After investigating the matter, officers said Smith’s story kept changing and there was no damage to Cook’s car. Police also noted that Cook had injuries consistent with abuse.
Cook, who registered a 0.18 blood alcohol content on a breath test, was charged with DWI, third-degree criminal mischief and unlicensed driver.
Smith was charged with domestic abuse.
PENDLETON
Several car break-ins reported
A rash of car break-ins on Campbell Boulevard and another on Tonawanda Creed Road were reported to the Niagara County Sheriffs Department on Friday.
A Campbell Road woman said four purses, a $300 camera, and five pairs of sunglasses and about $5 in changed were taken sometime overnight from the vehicle that was parked in the driveway.
A radar detector and a knife were taken from inside of another vehicle and about $5 in change was take from a second vehicle in the driveway. A third vehicle parked in the driveway that was locked was not entered.
A Campbell Boulevard man reported an unknown person stole a quart of oil, jumper cables and a tie-down trap from inside of his vehicle. About 10 CDs were taken from another car that was parked in the driveway and unlocked.
A Tonawanda Creek resident reported that someone took two cellular phones, a back pack and a black brief case from his car. The loss was $510.
Niagara Falls
• CHARGED: Lewis S. Roberts, 47, 462 81st St., was charged with driving while intoxicated and second-degree aggravated unlicensed operation about 3:30 a.m. Saturday, according to reports. Roberts was charged after police stopped him for failing to signal a turn. His blood alcohol content was measured at 0.16 percent.
• CHARGED: Three people were arrested after police stopped a car on 19th Street early Saturday morning. Falls Roving Anti-Crime Unit officers said they were on patrol about 3 a.m. when they saw a car driven by Mayan D. Riley, 29, 1702 18th St., blocking traffic on the 1500 block of Pine Avenue. After pulling the car over, police said Riley failed one field sobriety test and refused to take more. He was given the opportunity to take the tests again at police headquarters and passed one test and failed another. Police said he wouldn’t cooperate with an Intoxilizer test and was charged with DWI. Two passengers in the car, Regina D. Crittenden, 35, 1815 Weston Ave., and Darryl J. Hill, 29, 1845 Niagara Ave., were both charged with disorderly conduct after failing to comply with officers’ orders after the traffic stop was made.
• THEFT: A Bell Street resident told police that sometime between 7:30 a.m. and 3:30 p.m. Friday someone entered their house and took an envelope containing $2,000 that had been hidden under a bed.
City of Lockport
• CHARGED: Brian J. Herberger, 25,12 Merrimack St., Buffalo, was charged with speeding, failure to keep right and driving while intoxicated. At 4 a.m. Saturday, Pine Street police saw Herberger allegedly commit several driving infractions. Herberger had bloodshot eyes, slurred speech and smelled of alcohol. He failed sobriety tests.
• CHARGED: Jeremiah D. Smith, 31, 255 Genesee St., Apt. 3, was charged with second-degree harassment, second-degree obstruction of government administration and resisting arrest. Police responded to Genesee Street for a domestic dispute at 2:52 a.m. Saturday. The victim said Smith threw her down and struck her in the face before leaving. Later, the patrol was hailed down by the victim who said that Smith returned. Smith was found hiding in the basement and was arrested.
• CHARGED: Damen T. Speck, 407 Niagara St., was charged with disorderly conduct, unlawful possession of marijuana and seventh-degree possession of a controlled substance. Speck was in front of the Niagara Hotel, North Transit St., at 3:20 a.m. Saturday and refused to leave the area. He became abusive with officers, shouting obscenities. During booking, Speck was found with marijuana and four valium pills. Police were unable to fingerprint Speck due to his intoxication and combative nature, according to the report.
• ASSAULT: Peter J. DiGiacomo, 22, 6343 Robinson Road, Apt 3, was charged with second-degree robbery, second-degree assault and third-degree menacing. David L. Graves, 6343 Robinson Road, was charged with second-degree robbery and second-degree assault. Police responded to Niagara Street for the report of a robbery. The victim said the suspects pulled up in a dark-colored minivan and struck him several times and took cash out of and a pack of cigarettes out of his pocket. The victim said a woman in the van called, “Hurry up.” The victim had cuts and bruises on his face. He said the DiGiacomo threatened to kill him. The victim requested an order of protection against all parties. DiGiacomo and Graves were located on Robinson Road.
Town of Lockport
• SHOPLIFTING: Rebecca Marie Schaner, 16, 8408 Ridge Road, Gasport, was charged with petit larceny. Wal-Mart security reported they had two female shoplifters in their custody. The girls were accused of stealing $120.39 worth of merchandise which consisted primarily of makeup/beauty products. They were observed by store security concealing the products and walking past all points of purchase.
Middleport
• IDENTITY THEFT: A Middleport woman reported that an unknown person opened up an e-mail address in her name. According to the victim, she has been receiving phone calls from various businesses, stating they are returning an e-mail that the victim sent to them. The victim has also notified the New York State Consumer Protection Agency, Internet affairs unit, which is investigating the fraud. She has received extra charges on the her Verizon bill from Main Street Telephone, Nationwide Assistance, and Store Front Riches.
Wheatfield
• CHARGED: Antonio Devon Cook, 18, 7116 Packard Road, Niagara Falls, was charged with improper plates on a vehicle. Cook was stopped on Erica Lane on Friday after driving suspiciously and stopping in front of several residences. Cook said he was on his way to a friend’s house that was nearby. Patrol checked the vehicle’s registration and found that that displayed license plates were incorrect for the vehicle.
Lewiston
• CHARGED: Jesse A. Winchell, 19, 107 Dorwood Park, Ransomville, was charged with driving on shoulders/slopes of the road, failure to keep right and unlawful possession of marihuana Saturday morning. Deputies observed Winchell’s vehicle swerve on Route 31, crossing both the center line and fog line. Deputies found a marijuana pipe and a marijuana cigar that had not been lit in the car.
