A 42-year-old North Carolina woman initially charged in the shooting death of a woman in Niagara Falls won't be indicted on a murder charge.

Niagara County Judge Matthew Murphy said the grand jury chose to indict Cammesoa Williams on a charge of criminal possession of a weapon, not murder. The Winston-Salem resident was arrested along with her boyfriend in the shooting death of Tijuana Davis at the 39-year-old victim's apartment.

Williams' attorney Herbert L. Greenman successfully sought bail for his client.

Prosecutors said they couldn't discuss the indictment until an arraignment in a week.

Falls police detectives say Richard Henry Moore, 50, and Williams, 42, both of Winston-Salem, North Carolina, had come to the Cataract City in late September for a weekend wedding. While they were here they met Davis.

"We were told (Moore and Williams) met (Davis) through a friend and they went back to the victim's apartment (at 1828 North Ave., early Saturday morning)," Detective Lt. Michael Trane said. "They were there, drinking and playing cards."

What happened next left everyone who was in Davis' apartment baffled. Investigators said Williams, Davis and another women began to argue and then began fighting.

"(Moore) said he retrieved a gun and fired a warning shot that went into the wall," Trane said. "But the fight continued and then he ended up shooting (Davis)."

Davis suffered a gunshot wound to the stomach. Moore and Williams then fled from the apartment.

However, they returned a short time later and with Williams wielded the gun. Investigators said Williams shot Davis in the buttocks.

Falls Police patrol officers, responding to a call of the shooting, found Moore and Williams at the scene and then took both into custody without incident.

Detectives said they were able to speak to Davis before she was rushed to the Erie County Medical Center in Buffalo. She was rushed into surgery there but died several hours later.
