Man charged with DWI, drinking alcohol in car
A Niagara County Sheriff's deputy charged a man with DWI and drinking an alcoholic beverage in a vehicle Thursday night after spotting him driving erratically on Raymond Road.
On patrol about 8:30 p.m., the deputy saw Carl W. Clark, 42, 6035 S. Transit Road, Apt. 277, drifting over the fog line of the road and pulled him over. Clark appeared intoxicated and told the deputy he'd drank a beer in the car on his way home from work.
After failing field sobriety tests and tested positive on an alcohol breath screening test. After he was taken into custody, the deputy found an open 24 oz. Labatt Blue can of beer which was cold and two empty cans on the front passenger seat.
Clark told the deputy,"My lawyer from my previous DWI said that if I get another DWI, I'm (expletive)."
He refused to submit to a test to determine his blood alcohol content at the sheriff's office and was charged with DWI, first-degree aggravated unlicensed operation, open container law violation, driving without an interlock device and the traffic violation.
It wasn't stated when Clark was last charged with DWI.
• ARREST: A Falls man was arrested following a reported unwanted person report at 8:30 p.m. Friday in the 2000 block of Grand Avenue. Gene Loverdi, 57, 2034 Grand Ave., was charged with second-degree criminal trespass after a 31-year-old man reported Loverdi entered his apartment. The victim said he was playing with his children when the apartment door opened and Loverdi took about ten steps inside and stared at him. Fearing for the safety of his children, the victim said, he moved toward Loverdi, who ran from the apartment. The victim said he chased him into an apartment in the same building and called police. He was reportedly taken into custody without incident and identified by the victim.
