Wilson man arrested under Leandra's Law

Niagara County Sheriff's deputies responding to an accident in the area of Ide and Maple roads about 4:45 p.m. Saturday arrested a Wilson man after reportedly driving drunk with his daughter in the car.

While investigating the accident, the deputy found an empty Busch beer can in the driver's side back seat of a car belonging to Joseph C. Nugent, 46.

Nugent's daughter said they were returning from dropping off her sister at a friend's house and her father had been drinking prior to the accident. Nugent, injured in the accident, was flown by Mercy Flight to Erie County Medical Center where he was interviewed and charged by deputies.

Nugent, 46, 4750 Ide Road, was charged with aggravated DWI (for having a child under 16 in the vehicle), drinking in a vehicle, DWI and refusal to take a breath test.
