Police foil burglary, arrest one

A Buffalo man was arrested early Saturday morning following a reported burglary in progress at a convenience store in the 900 block of Pine Avenue.

Johnny Marks, 31, 184 Kay St., Buffalo, was charged with third-degree burglary, third-degree criminal mischief and fourth-degree grand larceny after police arrived at the scene and a witness identified him as one of two men who entered the store and stole merchandise.

The witness told police he observed two men enter the store and leave with a bag full of merchandise. They then took the bag and placed it in the trunk of a silver vehicle parked on Ninth Street. He said both men ran when police arrived at the scene and Marks was spotted walking across Pine Avenue from the store.

Police report finding the vehicle with its trunk open containing what appeared to be a plastic container of lottery tickets.

Police were unable to apprehend the second individual, who escaped by crossing through yards, the witness said.

• ARREST: A Falls man was arrested after officer on patrol was flagged down by an eatery employee at 2:30 a.m. Saturday in the 1800 block of Pierce Avenue. Michael Duncan, 41, 2722 Whitney Ave., was charged with disorderly conduct after he allegedly wouldn't leave a pizzeria after employees closed. Officers report Duncan, who they claim was highly intoxicated, eventually left the store and entered the roadway in front of the store, laid down and started making snow angels.

• THEFT: Police are investigating a reported theft from a vehicle which occurred between 10:30 p.m. Friday and 7 a.m. Saturday in the 9700 block of Niagara Falls Boulevard. The victim, a 36-year-old man, said someone smashed his driver's-side window and took various audio equipment from inside the vehicle. He estimated the damages and lost property were valued at $2,400.
