Falls police arrested a Zito Drive man after it was reported he had fired off shots from a pistol near an ice cream stand on Niagara Falls Boulevard Tuesday afternoon.
Police were called to a gas station on the corner of Tuscarora Road and Niagara Falls Boulevard about 8:45 p.m. Tuesday for a report of a man firing shots from a gun outside the store. The man then left the area, walking east down the Boulevard.
A police officer caught up with Jose A. Colon Sr., 26, 9021 Zito Dr., Apt. 41, and ordered him to drop the weapon at gunpoint. Colon complied and was taken into custody without incident.
A witness told police Colon confronted him at the gas station and accused him of almost hitting his daughter with his car. Colon then fired shots from the gun. Police noted that several people were outside at a nearby ice cream stand at the time.
About 45 minutes after the incident, police were called to a Zito Drive home for a report of a stolen gun. A resident said he came home about 9:30 p.m. to find his revolver, box of ammo and $150 in change gone from the residence. The serial number of the missing gun matched the gun Colon was carrying when stopped by police.
Colon was eventually charged with first-degree reckless endangerment, second-degree menacing, second-degree burglary, fourth-degree grand larceny and petit larceny.
