Crash cases closed|Drivers in fatal Lewiston pedestrian accident, Falls dump truck crash ticketed

Niagara Gazette — The driver of a car in a fatal accident in the Village of Lewiston will only face a traffic charge in connection with the incident.

Lewiston police said the man, who has not been identified, will be charged with failure to yield to a pedestrian. 

Investigators said there was no intent by the driver to hit the 71-year-old victim and no evidence of the use of alcohol or drugs by the driver.

The victim, who also has not been publicly identified, passed away from her injuries at the Erie County Medical Center last week.

Investigators with the Lewiston Police and the Niagara County Sheriff's Office said the woman was walking her dog and was crossing Center Street on June 2, when a car making a right-hand turn from Seventh Street struck both her and her pet.

The accident occurred about 2:30 p.m. and the victim was treated at the scene by Lewiston No. 1 EMS, before being flown by Mercy Flight to ECMC. She was in critical condition when she arrived at ECMC.

Police said the victim’s dog was also injured, but is expected to recover.

Also on Friday, Falls Traffic Division crash investigators said they will charge a dump truck driver in connection with an accident that left a 49-year-old woman with significant injuries earlier this week.

Traffic Division Capt. Angela Munn said the driver faces a single count of failure to yield the right of way (to oncoming traffic).

Investigators said the 2003 Infiniti, driven by the woman, was traveling east on Niagara Falls Boulevard, in the right-hand lane, at 3:05 p.m. Tuesday, when it was struck broadside by the dump truck. The truck, driven by a 64-year-old man, was making a left-hand turn from the westbound turning lane on Niagara Falls Boulevard onto the I-190 South on-ramp.
