DNA exonerates suspect in slaying of Lockport man

BUFFALO — A murder charge against a 23-year-old Buffalo man has been dropped after prosecutors say DNA pointed to a different suspect.

Erie County District Attorney Frank Sedita III says Wednesday the indictment against Charles Tubbins has been dismissed and a new suspect is in custody in the 2012 shooting of Rashiene Carson.

Tubbins had been charged based on witness identifications shortly after Carson, of Lockport, was shot while being robbed inside a car at a Buffalo gas station. But prosecutors began to have doubts when DNA from the car's door handle didn't match Tubbins. Sedita says the state DNA databank matched it to convicted felon Ahkeem Huffman. Now the 20-year-old Huffman — who resembles Tubbins — is charged.

He pleaded not guilty Wednesday and was assigned a lawyer.
