Man wanted on felony cruelty to animals warrant caught after chase

A Niagara County Sheriff's deputy on patrol early Thursday morning caught a man wanted on a felony aggravated cruelty to animals originating from a May 2012 incident in which he slammed his grandmother's dog to the floor, severely injuring it.

The deputy said he was on patrol about 12:30 a.m. on Stieg Road in Wheatfield when he noticed a man riding a bike wearing dark clothing with a backpack.

The deputy pulled up behind the bike rider, later identified as Jason E. Evrard and tried to stop him as they turned onto Errick Road. Instead, Evrard quickly turned into a nearby driveway and rode into the backyard. Evrard went around the residence but was followed by the deputy in his patrol car.

When Evrard again attempted to ride behind the residence, the deputy exited his car and went around the opposite side of the house and ordered him to stop or he would use a Taser.

Evrard kept riding and the deputy deployed his Taser as they were about 10 feet apart. Evrard was struck in the back, at which point he fell to the ground yelling, "I'm done. I'm done." 

The deputy said he secured Evrard without further incident and found him to have an active felony warrant for aggravated cruelty to animals.

The charge stems from a May 2012 incident in which he slammed his grandmother's Lhasa Apso dog to the ground, fracturing its pelvis.

At his sentencing in November, Evrard was sentenced to five years probation for his guilty plea to a single felony count of aggravated cruelty to animals. At the time of his sentencing, State Supreme Court Justice Richard Kloch Sr. told Evrard he could be sent to state prison for up to four years if he violated the terms of his probation.

After the incident Thursday morning, Evrard, 28, 6683 Walmore Road, was also charged with trespassing and resisting arrest.

He was taken to Niagara County Jail where he is being held without bail.
