Lewiston police make Leandra's Law arrest

Niagara Gazette — Lewiston police arrested a Niagara Falls woman for a violation of New York's Leandra's Law following a traffic stop Wednesday on Saunders Settlement Road.

A police report indicated that the woman, 18-year-old Ellen Lester, was pulled over by an officer at 10:31 p.m. Wednesday for traveling 55 mph in a 40 mph zone. According to reports, the officer detected a "strong odor of marijuana" emanating from the vehicle and an unrestrained 2-year-old child in the backseat. 

Lester was taken by police to the New York State Police barracks where officers said she failed several field sobriety tests. 

Reports indicated that police found just over half a gram of marijuana in her vehicle. Lester was arrested for multiple charges, including DWI, operating a motor vehicle while impaired by drugs, aggravated DWI with a child passenger younger than 16, speeding, backseat passenger unrestrained, unlawful possession of marijuana and endangering the welfare of a child. 

Reports indicated that police notified Child Protective Services following the traffic stop and that Lester was arraigned before Lewiston Town Justice Thomas Sheeran who set a cash bail of $2,500. Lester was remanded to the Niagara County Jail.

Leandra's Law makes it an automatic felony on the first offense to drive drunk with a person age 15 or younger inside the vehicle while the operator of the vehicle has a Blood Alcohol Content of 0.08 percent or greater, or is intoxicated due to drug or alcohol ingestion.
