Driver charged with violating Leandra's Law in Wheatfield

A Tonawanda man was charged with a Leandra's Law violation after a traffic stop on Shawnee Road about 11:45 p.m. Saturday.

A Niagara County Sheriff's deputy said he was following a vehicle being driven by Adam K. Rosehart who was driving about 10 miles under the 55 mph speed limit and weaving in and out of the lane.

After being pulled over, it was determined that Rosehart, who was traveling with his wife and 5-year-old daughter, did not have a driver's license because he said he hadn't paid a fine.

The deputy said it appeared Rosehart was intoxicated and he failed field sobriety tests. After being charged, a records check determined that his driver's license had three suspensions with one of them a scofflaw. The other two were for insurance lapses.

A breath test determined Rosehart's blood alcohol content to be 0.14 percent.

Rosehart, 31, 198 Old Colony Road, Tonawanda,  was charged with the Leandra's Law violation — aggravated DWI with a child in the car, third-degree aggravated unlicensed operation, DWI and moving from a lane unsafely.

His wife and daughter were taken to a nearby coffee shop by deputies.
