Co-defendant in Bradberry murder case could be re-charged with homicide

Niagara Gazette — LOCKPORT — One of Matthew "Bones" Davis' two murder trial co-defendants has now testified against him.

His other co-defendant will not.

As a result of that decision, Chasity Wilson could end up being re-charged with the murder of Antoine Bradberry.

The confrontation between prosecutors and a potential star witness played out Monday morning, without the jurors hearing Davis' case being present in the courtroom. The jury has already heard Davis' one-time girlfriend, Teara Fatico, testify that he was the mastermind of a botched robbery that left Bradberry dead in his Rainbow Boulevard apartment in August 2011.

Wilson and Fatico were each arrested and charged, within days of the slaying, with second-degree murder and first-degree robbery in the case. However, in November 2011, they both pleaded guilty to attempted first-degree burglary and agreed to testify against Davis.

Both admitted that they played a role in the murder, but each fingered Davis as the killer. The pair are now each serving 13-year prison terms at the state's Bedford Hills Correctional Facility.

Wilson told Niagara County Court Judge Matthew J. Murphy III that if she was forced to testify against Davis she would refuse to answer any questions from prosecutors. That refusal could have resulted in Murphy charging her with contempt.

Prosecutors told the judge because Wilson would not cooperate, they would not call her as a witness. However, since her cooperation at Davis' trial was a condition of her plea deal, prosecutors confirmed that could ask to have her plea and sentence set aside and seek to try her on the original charges she faced.

First Assistant District Attorney Doreen Hoffman said no decision on that would be made until after Davis' trial was completed.

In testimony Thursday and Friday, Fatico told jurors Davis sent her and Wilson to Bradberry's apartment to “see what (they) could get out of him.” Fatico said she had become friends with Wilson because she was dating her cousin.
