Animal cruelty defendant gets jail time

Niagara Gazette — LOCKPORT -- A man serving five years probation for aggravated animal cruelty will now spend a year behind bars for violating the terms of his probation.

State Supreme Court Justice Richard Kloch Sr. sentenced Jason Evrard, 28, to a year in jail for admitting he dropped out of drug and alcohol rehab and stopped showing up for meetings with his probation officer.

When his defense attorney started to object to Kloch’s sentence, Evrard cut him off and told him to oppose the jail time.

“What you really need is some time away from drugs,” Kloch told Evrard.

“Your honor, I’m getting that right now,”Evrard replied.

Evrard was originally charged in connection with a May 2012 incident when he slammed his grandmother’s Lhasa Apso dog to the ground, fracturing its pelvis. He was charged with a single felony count of aggravated cruelty to animals.

In November, he pleaded guilty to that charge and Kloch sentenced him to five years probation. At the time of his sentencing, Kloch warned Evrard that if he violated the terms of his probation, he would face up to four years in state prison.

County probation officers said they had “no idea” where Evrard was after he left rehab and stopped showing up for appointments with the officer assigned to his case. Kloch then issued a warrant for Evrard’s arrest. 

Sheriff’s deputies caught up with Evrard on July 11, when they spotted him riding a bike on Stieg Road in Wheatfield. Evrard tried to run from the deputies and was taken into custody after being Tasered.

Evrard is stil facing charges of resisting arrest  and trespassing, in Wheatfield Town Court, as a result of that incident.
